The good news is, when it comes to purchasing a home, YOU as the buyer have the power to choose your attorney, which means you have the freedom to select representation you can trust. What Is Real Estate Law?

Real estate law entails all dealings, transactions, and contracts between a seller, buyer, landlord, and tenant in regard to residential or commercial property. It also includes potential issues of interest regarding easements, zoning laws, property value analysis, options for sale/purchase at a later time, encumbrances on land (like liens), title insurance policies, and more. When it comes to the simple purchase of a home, legal issues can arise that complicate the transaction- and that’s where a trustworthy attorney that is well-versed in real estate and local law comes in.

Needed legal advice and as soon as I called I felt that I would be well taken care of. Very professional, personable, and supportive. I got the answers I needed quickly and will definitely be my go-to in the future!

Why Do I Need a Real Estate Attorney?

Having an experienced legal team is crucial to successful real estate deals because oftentimes, issues can arise that the current owner is unaware of. Your real estate attorney can help you when:

There is a problem with the property (such as an IRS tax lien that the homeowner forgot to mention before selling you the house!) and you need someone to defend or file lawsuits on your behalf.

Legal documents and contracts, written in “legalese”, are difficult to interpret and you need someone to make changes that benefit you where necessary. Attorneys can assist in reviewing inspections, leases, appraisals, and purchases to make sure you are covered.

You want to ensure you won’t have to pay extra fees and file additional paperwork due to loan application errors.

You want some added protection against pushy sellers, escrow agents, or brokers in the event things turn ugly in the negotiations.

We can assist you with the preparation of the documents you need to sell your home. If you want to sell it yourself or if you are listing it with one of the amazing local agencies, we can prepare your documents for you prior to closing and get them to the closing table for you.

Title problems arise in the selling process and a knowledgeable attorney is needed to remove title defects.

You have found a home and now you need an attorney to help you close and finalize your purchase. Whether you are purchasing a home with owner financing or lender financing, we can help you complete your purchase easily and efficiently.

How We Can Help With Property Disputes?

At Koontz Law, our professional and experienced attorney can also help when it comes to the following involving property disputes in North Carolina:

Easements.  An easement is a legal right that allows a person to use someone else’s land for a specific purpose. An easement is most commonly created by an explicit grant in a deed or other recorded instrument, such as a survey. Easements generally exist out of convenience or necessity for neighboring property owners. Easement disputes most commonly occur when there is no clear documentation creating the easement with a well drafted description, location, purpose, and any restrictions or terms included.

Petition to Partition. You may fall underneath this category if:

  • We can’t agree on how to divide the property
  • Not Married but we own property together
  • When people who are not married own real estate with one another, conflicts regarding the property may arise.  When conflicts of this nature do arise, and the people cannot agree on a resolution.  North Carolina law states that a cotenant of a parcel of real property may petition the court to partition the property physically, or by sale, in the alternative. There are different factors for determining how the property dispute will be resolved and it is important to consult with an experienced attorney on these matters.

Drafting Leases and Contracts. Drafting your own contracts or leases are a recipe for disputes, defalcations, disaster, and ultimately, wildly expensive litigation. Furthermore, a form contract drafted by some mysterious person on the internet will absolutely fail to care for all the nuances of your unique, individual situation:

  • Addendums to Standard Residential and Commercial Real Estate Contracts
  • For Sale By Owner purchase or sale
  • Preparation and/or review of rental and leasing agreements
  • Owner Financing or Installment Purchase Land Agreements

The Bigger Picture of Real Estate Law

A well-rounded attorney understands that real estate transactions are much more than the exchange of property. Oftentimes, the buying and selling of a house can involve other areas of law as well, including family law in the case of divorces, property passed down through trusts and wills, or even criminal law if a home is used as collateral to bond someone out of jail. Legal matters can be interconnected in sometimes complex and confusing ways, and the professionals at Koontz Law are able to see and make sense of the bigger picture. You can depend on our team to use their expertise in all of these different areas of law to get you the best results possible.
